1. Acceptance of Terms
Welcome to Starship Stays, LLC ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website located at starshipstays.spitzworks.com and related services (collectively, the "Platform").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.
2. Description of Services
The Platform provides an online marketplace that enables:
- Property owners or authorized users ("Star Hosts") to list rental properties located in the United States
- Star Guests ("Star Guests") to search for and book short-term or long-term stays
The Company may list its own properties and also facilitates listings by third-party Star Hosts.
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Platform. By using the Platform, you represent and warrant that you meet these requirements.
4. User Accounts
To access certain features, you must create an account.
You agree to:
- Provide accurate and complete information
- Maintain the security of your login credentials
- Notify us immediately of unauthorized use
We reserve the right to suspend or terminate accounts at our discretion.
5. Star Host Terms
a. Listings
Star Hosts are responsible for:
- Accuracy of property descriptions, pricing, and availability
- Ensuring the property complies with all applicable laws, regulations, and zoning requirements
- Maintaining the property in a safe and habitable condition
b. Agreements with Star Guests
Star Hosts enter into a direct contractual relationship with Star Guests when a booking is confirmed. The Company is not a party to that agreement, except where it is the Star Host.
c. Taxes and Compliance
Star Hosts are responsible for determining and fulfilling their tax obligations, including occupancy taxes and reporting requirements.
6. Star Guest Terms
Star Guests agree to:
- Provide accurate booking and payment information
- Comply with all house rules set by Star Hosts
- Treat properties with care and respect
Star Guests are responsible for any damage caused during their stay.
7. Bookings and Payments
a. Booking Confirmation
A booking is confirmed when payment is successfully processed.
b. Payment Processing
Payments are processed through a third-party payment processor (Stripe). By making a payment, you agree to comply with Stripe’s terms and policies.
c. Fees
We do not charge fees.
8. Cancellations and Refunds
Cancellation and refund policies may vary depending on the Star Host and listing. Applicable policies will be displayed at the time of booking.
The Company may, but is not obligated to, mediate disputes regarding cancellations or refunds.
9. Prohibited Activities
You agree not to:
- Use the Platform for unlawful purposes
- Provide false or misleading information
- Circumvent payment systems
- Harass, threaten, or harm other users
- List properties you are not authorized to rent
- Interfere with the operation or security of the Platform
10. Content and Listings
a. User Content
You retain ownership of content you submit (e.g., listings, photos), but grant the Company a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the Platform.
b. Removal
We reserve the right to remove or modify content that violates these Terms or applicable laws.
11. Reviews and Ratings
Users may leave reviews and ratings. Reviews must be truthful and not defamatory, fraudulent, or misleading.
We reserve the right to remove reviews at our discretion.
12. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
We do not guarantee:
- The accuracy of listings
- The conduct of users
- The quality or safety of properties
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- LOSS OF PROFITS, DATA, OR GOODWILL
- PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM BOOKINGS OR STAYS
Our total liability shall not exceed the total amount paid by you to the Company in the twelve (12) months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless the Company and its affiliates from any claims, damages, losses, or expenses arising out of:
- Your use of the Platform
- Your violation of these Terms
- Your interaction with other users
15. Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including violation of these Terms.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Connecticut, without regard to conflict of law principles.
Any disputes arising under these Terms shall be resolved in the state or federal courts located in Connecticut, and you consent to their jurisdiction.
17. Changes to These Terms
We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
18. Third-Party Services
The Platform may integrate with third-party services, including payment processors such as Stripe. We are not responsible for third-party services or their terms.
19. Entire Agreement
These Terms constitute the entire agreement between you and the Company regarding the Platform and supersede all prior agreements.
